Hatchet job or Hatch Act? Sacramento Mayor Fargo may have broken federal law

Hatch Act 1939 Laws Against Abusing OfficeOn May 22, 1992, Mr. Johnny Carson appeared on the tonight show for the last time. Exactly sixteen years later, on May 22, 2008, Heather Fargo may have held her last performance as well. That was the day our entitlement-minded mayor announced from our city hall building that she was demanding the Sacramento police department redirect resources from investigating real crimes to investigating her opponent, Kevin Johnson. Her reasoning? If a crime had been committed on “her watch,” she was obligated to investigate it (Ed. note: nice of her to finally acknowledge we have a police department, at least)

When the feds are done investigating St Hope, it looks like they’ll be stopping by city hall to pay Mayor Fargo a visit on their way out of town. RE Graswich has the scoop for you..

  • use official authority or influence to interfere with an election
  • engage in political activity while:
    • on duty

Maybe I’m not going to get my interview after all. Perhaps very shortly Fargo might be saying the same thing Johnny did 16 years ago moments before the curtains closed for the final time on his long running variety show:

“I bid you a very heartfelt good night. “

    Good catch. I checked it out, but could not find a source that indicates Fargo is subject to the Hatch Act. As far as I can tell, it applies to state and local employees if their positions are primarily paid for with federal funding. Do you know if that’s true?

  4. 6, the acid test is apparently not federally funded salary per se. Read the brief I pasted below. It reads, “Langford [former mayor of Atlantic City, NJ] is covered by the Hatch Act because his primary job duties are in connection with programs that are financed, in whole or in part, by federal loans or grants.” Read here

    Sac City has programs that are financed, in whole, or in part, by federal loans and grants. One such program is road resurfacing and repair Read here
